Emma Harty’s work focuses on litigation, prosecution, transactional work, due diligence and licensing of intellectual property rights, including patents, trademarks, copyrights and trade secrets. Her patent litigation experience includes cases in a wide range of technologies including, for example, business methods, electronic medical records, banking/finance, network testing applications, design patents, automotive parts and assemblies, fuel-tank inerting systems, large format UV printers, motor technologies and car haulers. Her trademark litigation experience includes infringement litigation in district court, opposition proceedings before the Trademark Trial and Appeal Board, and Section 337 proceedings before the International Trade Commission.
Ms. Harty also has counseled clients involving intellectual property issues in a wide range of industries including computer hardware and software, business methods (including banking/finance, general e-commerce, and Internet infrastructure), telecommunications, electronics, medical devices and systems, manufacturing methods, and various consumer goods.
In addition to her litigation practice, Ms. Harty has experience with preparation and prosecution of both patent and trademark matters. Ms. Harty regularly advises clients on patent validity and infringement issues, including product clearance opinions. She also advises clients on the availability of trademarks for use and registration, negotiates and prepares intellectual property agreements, and performs intellectual property due diligence in connection with mergers, acquisitions and investments made by clients.
Prior to joining the firm, Ms. Harty was an associate with a Phoenix, Ariz. law firm where she focused her practice on intellectual property matters. Her undergraduate degree is in optical engineering.
